Please read our Terms and Conditions (“the Terms”) carefully before purchasing any services. By signing our terms condition or ticking the accept box you are confirming that you have read the Terms and agree to be bound by them. These Terms together with the items listed in paragraph two, below, constitute a contract between you (the client) and us (Elevated Pilates Ltd).
It is a condition of us allowing you to use our studio as a client or member, class pass user or guest, that you agree to our terms and conditions.
1. Introduction
All classes and workshops (collectively referred to as “Sessions” for the purposes of these Terms) provided at our premises or by us Elevated Pilates Ltd, (whose registered office is Unit 6 Brooklands, Budshead Road, Devon, PL6 5XR, UK and whose company number is 15992941), subject to the following express Terms. In these Terms “we”/”us”/”our” means Elevated Pilates Ltd. And “you”/”your”/”yours” means you, the client.
2. Data Protection Notice
The nature of our business and the provision by us of sessions to you means that we will collect and process some of your personal data from time to time. We will only do so in accordance with our Privacy Notice, which you can read in our Privacy Policy on our website. Your data will only be provided to our Third Party App ‘BSport’ for the purpose of booking and notifications to confirm your booking or notify you of any changes to your booking.
3. Your Account
In order to book sessions, you must sign up for an account (Account) in our app or through our Website.
We highly recommend that you sign up for notifications through our App so that we can keep you up to date on any class changes and confirmation of your class bookings. Notifications will be sent via email, App or both. If you choose to opt out, you will NOT be notified of class booking confirmations, when a space becomes available on the waitlist for a class you may want to attend or last minute class changes.
You must be at least 18 years of age to attend any Sessions at Elevated Pilates Ltd and create an account. Parental consent is required for individuals 14-18 years old and will be required to attend with parent or guardian. Children under the age of 14 can NOT attend sessions without prior approval from management or accompaniment by their parent or guardian.
Only the owner of the account (client) can book and attend classes under the specific account name. The memberships and packages in the account can only be used by the owner of the account (client) and cannot be transferred.
4. Booking classes/ Private Equipment Classes
The cost of each Session will be shown clearly on the website, app and online booking system, elevatedpilates.co.uk or our Elevated Pilates App. Bookings for classes can be made on any classes that have availability and can be booked up to 90 days in advance when applicable.
Bookings can be made via the app link on the website; through an e-mail to info@elevatedpilates.co.uk and with assistance from staff to process the booking; over the phone or in person on the premises.
It is your responsibility to ensure that you have made your booking and (where relevant) submitted payment correctly. The people booked onto the class at the start of class have priority to attend the class. If you arrive late*, you forego your space to the first available person on the waiting list.
*Late is defined as anyone arriving 2 minutes past the start time of the class session as posted on the timetable. For example, if the class is due to start at 9:30 and you arrive after 9:32 you will not be allowed to enter the class. If there is a client available to take the spot at that time (9:32), that space will be given to them.
If you are late*, we kindly ask that you offer courtesy to staff and clients alike and not cause disruption by using the intercom, calling the studio or knocking on the door. This is an interruption of class session that has already started.
Doors will be open to clients for session 10 minutes prior to each scheduled session to ensure that you are able to get in situ before class starts.
Make sure you note the expiry date for each single class or class packs, memberships or workshops. It can also be found on your receipt and on your account via the Elevated Pilates app.
Limited time offers may have different expiration dates and validity restrictions. See terms and conditions for each package.
The general expiry dates are:
Introductory Offer expires 30 days from purchase.
Single Class Pass expires 30 days from purchase.
5 Class Pack will expire 8 weeks from date of purchase.
1:1 Private Equipment Session* expires 8 weeks from date of purchase.
10 Class pack expires 12 weeks from date of purchase.
20 Class pack expires 6 months from the date of purchase.
1:1 Private Equipment Session Pack expires 12 weeks from date of purchase.
Prenatal and Postnatal Class Packs expire 6 months from purchase date and can be used interchangeably. For example, any passes not utilized during your Prenatal period for medical reasons, can be carried over to Postnatal Class registration.
Courses are non-refundable and expire 6 weeks after purchase date.
*Unlimited: Maximum one class per day. No show and late cancellations will be charged at full rate automatically with the payment method on file; special conditions apply for rolling contract and memberships. No-Show and Cancellation Fee for unlimited package is £10.
*First Class/ Introductory Offer and/or 1:1 Private Equipment Session Pass is limited to 1class per person.
Bookings through third-party providers such as Bsport and others follow their terms and conditions, as they are the responsible sales agent.
5. Pre- And Post-natal Policy & Passes
Up to 15 weeks pregnant, Doctors approval and medical clearance from GP is required for high-risk pregnancy. You may continue group classes up to the 13th week.
At 14 weeks pregnant or more: You cannot attend our group classes after you are 14 weeks pregnant. Exceptions to this are our Prenatal class or a 1:1 Pilates Reformer Equipment Session. You will need to fill out a Prenatal Form prior to your first session to ensure we can cater to any additional needs you may have.
Post-natal: Every mother’s postpartum experience is different and therefore everybody is different. You will need clearance by your GP to resume exercise. We also recommend that you consult a Pelvic Floor Physiotherapist prior to attending or resuming exercise. General return to exercise postpartum protocols are followed at Elevated Pilates. We welcome mums to join our Postnatal Class 6 weeks following vaginal delivery and 8 weeks following a C-section delivery in conjunction with clearance by a health professional. It is your responsibility to inform your instructor of any postpartum complications and functional limitations or contraindications.
You will need to fill out a Postnatal form prior to your first session.
Your form must be emailed to info@elevatedpilates.co.uk prior to your first session which will be added to your client profile. Our aim is to ensure you are progressed safely back to exercise.
To attend Pre- and Postnatal classes, simply purchase a Single Prenatal/Postnatal Class Pass or purchase a Prenatal or Postnatal 4 Class Pass through our App. You will be automatically registered for 4 consecutive sessions to guarantee your space in our course. Spaces are limited. If there is any reason you will not be able to attend your scheduled session it is your responsibility to communicate to the instructor directly in person at the first session of your 4 week course or via email to info@elevatedpilates.co.uk Please title your email Prenatal or Postnatal Schedule.
A Postnatal Class on your account can be used in our group session classes when you are cleared to attend, however our general group class passes cannot be used to book Pre/Postnatal sessions. If you want to book onto a regular group session you will need to email in to info@elevatedpilates.co.uk or speak to management directly to process this for you.
6. Payment
Payment for your Sessions must be made at the time of booking and can be made in studio online through our website or app, over the phone or with the use of a gift voucher.
7. Memberships
Memberships are non-transferrable.
Annual memberships are based on a 12-month contract.
Memberships are set up as a direct debit and will be debited automatically from the card on file on the same date every 12 months. It is the client’s responsibility to ensure that credit card information is up to date andthere is no interruption to membership.

All memberships require the client to pay for their chosen membership when they subscribe. They will then be billed on the same date on a recurring monthly basis or annual basis. Clients are required to agree to the terms and conditions of payment, ensuring an up-to-date card is kept on file.
Unfortunately, you will not be able to attend your session unless payment is taken, and any credit settled prior to your class attendance. Unused classes cannot be carried over and are non-transferrable to other members/ clients.
Memberships can be frozen for a maximum of 2 months.
To freeze a membership, notice must be given in writing at least 10 days prior to the membership renewal processing date. Please email info@elevatedpilates.co.uk stating you wish to freeze your membership.
Memberships can be cancelled after an initial 3-month period.
To cancel a membership, notice must be given in writing at least 30 days prior to the membership renewal processing date and you agree to a fee equal to 10% of your remaining contract. Please email info@elevatedpilates.co.uk stating you wish to cancel your membership.
Any failed or overdue payments must be cleared before booking sessions or cancelling memberships.
If a billing date change needs to be made, please email info@elevatedpilates.co.uk and detail the specific date you would like to change the billing date to.
Management reserves the right to alter, amend or change the Terms & Conditions from time to time. The version on this website being the most up to date available and members will be notified via their preferred means of communication, email or App notification. If the client has chosen to opt-out from both or either, it becomes the client’s responsibility to verify Terms and Conditions before every purchase, including rolling debits.
8. Discount Codes / Coupons
From time to time, we may make discount codes available to you, and your use of any such discount codes shall be subject to additional terms and conditions, which we will make you aware of at the time of use.
Discount codes may only apply to certain sessions, and we will set this out in our applicable promotional communications.
In the event that sessions booked using a discount code are cancelled, the relevant session will be cancelled in accordance with the Terms. In addition:
we reserve the right to end or withdraw any Discount Code without warning at any time;
we also reserve the right to withdraw your right to use any Discount Code if we consider, in our absolute discretion, that you have abused, misused or gained an unfair advantage in respect of the Discount Code;
additionally, we reserve the right to not fulfil any future session bookings made by any customer found to have abused, misused or gained an unfair advantage in respect of the Discount Code.
Your passes are non-transferable and therefore your class passes/ membership can be revoked it is brought to our attention that another individual is using your class pass.
9. Promotional Offers
From time to time, we may run various promotions, prize draws and other offers (each a promotion).
We may implement separate terms and conditions in respect of any such promotion and will advise you accordingly where this is the case. However, notwithstanding this:
we reserve the right to end any promotion without warning at any time.
we also reserve the right to withdraw your right to any Promotion if we consider, in our absolute discretion, that you have abused, misused or gained an unfair advantage in respect of the Misuse includes, but is not limited to, the creation of multiple customer accounts and self-referral.
additionally, we reserve the right to not fulfil any future Sessions bookings made by any customer found to have abused, misused or gained an unfair advantage in respect of the Promotion.
any prizes offered by us in connection with a Promotion must be claimed within 21 days of the announcement date of the winners. We have 45 days to issue any such prize. We reserve the right to substitute any prize or promotion for the equivalent value in sessions.
10. Merchandise
From time to time, we may make various products available for you to purchase via our Website or at our studio and we may elect to implement specific terms and conditions or policies that apply to any purchase you may make of such products or where you wish to return products to us after purchase. This does not affect your statutory rights.
11. Changing or Cancelling a Booking & No Shows
You may change or cancel your booking, without charge, up to 12 hours before the start of the session that you have booked for.
If you book onto a session within 12 hours of its scheduled start time, there is no entitlement to change or cancel.
You may change or cancel a session booking online, e-mail, or in person at the studio at which the session is scheduled to occur.
With regards to packages and memberships, if you cancel a booking less than 12 hours prior to the start of the session then the class will not be credited back to your account balance.
With regards to unlimited packages and memberships specifically, if you cancel a booking in less than 12 hours prior to the start of the session or if you do not attend the session (regarded as No-Show), then you will be charged a £10 Cancellation Fee or £10 No-Show Fee.
12. Studio Class Cancellations
In the event that the studio must cancel a session that you have booked onto, as a result of an unforeseeable circumstances or event, the Studio will make reasonable efforts to contact you by email and/or App notifications to let you know as soon as possible.
The studio will credit the pass back onto your account, so you are able to use the class pass for a future session. If it is the last session in you class pack at the expiry date, you can email into info@elevatedpilates.co.uk and we will make appropriate accommodations to ensure you are able to utilize your pass.
13. Booking Confirmation
Upon completion of your booking, you will have the option to receive notifications.
You have the option to receive notifications, either by email, app notification or both to say you are booked onto a particular class.
If you choose to opt out of notifications then you will not receive any notifications of your confirmed booking, class changes if they arise, or confirmation of you, as the client, having been added onto a class from the waitlist. For these reasons, we highly recommend you opt-in to at minimum to one form of notification. Other than for class information, we will not be sending other text messages. If you are unsure of your booking, please check the App or feel free to contact us by phone or email. Our studio number is +44 (0)7849745614.
Prices are subject to change at any time before we accept your booking.
All Sessions are offered by us and subject to availability.
We do not guarantee availability at any time.
14. Waitlists
If a Session is fully booked, then you may either: (i) join an alternative Session; or (ii) join a waiting list for the fully booked Session.
If you are on the waiting list for a fully booked Session and a space becomes available, you will automatically receive an email to prompt you to book onto the class, on a first come first serve basis you book, a relevant credit will be deducted from your account, and you will receive a class booking confirmation.
You will not, however, be added to the Session if you do not have sufficient credits on your Account, or the Session is not otherwise included in a Package or Monthly Membership that you have purchased.
15. Late Cancellation Policy
Late Cancellation is defined as anyone that is cancelling a session less than 12 hours prior to the start of your booked session Late cancel is always defined as a client that is late attending a session.

Doors will be open to clients for session 10 minutes prior to each scheduled session to ensure that you are able to get in situ before class starts. This ensures that you are able to get set up use facilities prior to the start of your session.
Reformer Pilates is a mindful practice and therefore expect limited interruptions to ensure everyone benefits the most from their session. This policy is in place to prevent injury and to be mindful and considerate to the teacher and other participants in the Session. Where you are not permitted to join a Session because of your late arrival it shall be classed as a no-show for the purposes of clause 11.
16. Price changes
We are a small business and reserve the right to review and change prices periodically. Clients will be notified of changes before implementation with a minimum of 30-day notice.
17. Refunds
The client is entitled to 24 hour “cooling off period” from the date and time of purchase to request a refund for any unused, valid single class pass or any unused portion of a valid class pack. After the “cooling period” no refunds will be issued. In case of emergency or relocation, such as medical reasons or moving residence, we request evidence documentation. Documentation such as a medical certificate / letter, government issued letters, new lease / rental agreement can be accepted to obtain such refund.
18. Contact Us
Life happens and we are aware that not all circumstances are in your control. Please reach out to us if you have any questions, concerns, or for unforeseen circumstances that impacted you getting to us as scheduled. Each situation will be treated with respect and based on circumstance. Refunds cannot be processed however we will work together to come up with a fair resolution as needed. Please send all communications via email us to info@elevatedpilates.co.uk or feel free to call +44 (0)7849745614 and a studio manager will return your call you at their earliest convenience within 2 working days from when the call was received. Phone calls will not be picked up during teaching hours on our timetable. You can make changes to your class bookings via the App or email.
These requests will follow the cancellation policy as stated in these Terms and Conditions.
We may contact you using any of the contact details you provide to us when you sign up for an account, which may include via email, telephone or text message. Our Privacy Policy sets out how we may process your personal data, which includes the contact details you provide to us.
19. Fitness and Health
By agreeing to these Terms and Conditions, clients hereby declare that he/she is in good physical condition and can engage in the active and passive exercises. Any illness or condition must be discussed with the instructor prior to starting the exercises.
It is the Client’s sole responsibility to notify the Studio before attending any session of any circumstances affecting their health which may be exacerbated through continued use of the Studio and/or which may have arisen or worsened since their last session at the Studio (if any).
Clients are advised not to undertake strenuous physical activity without first seeking medical advice if they have concerns over their physical condition and wellbeing. Clients with low/high blood pressure and/or cardiac irregularities should not attend class before consulting their GP.
Clients may train (with consent from their doctor) during pregnancy.
The Studio reserves the right to refuse access to any Clients if, in its absolute discretion, it considers that the health of the individual concerned may be endangered using Studio facilities.
Clients are required to always follow the instructions of the instructor.
Clients must fill in the Health & Safety Questionnaire prior to their first visit to the studio. It is responsibility of the client to ensure the questionnaire is completed and is truthful to reflect the current condition of the client. It is responsibility of the client to update the Health & Safety records if the condition of the client has changed.
20. Limitation of liability
The Company cannot be held responsible for any session, instructor and/or item of Pilates equipment not being available for whatever reason. The Company reserves the right to make alterations to the sessions, instructors and/or equipment, as well as to those ancillary facilities (e.g. toilets), provided to Clients, without notice and in its absolute discretion and the Company will not be liable for any loss occasioned by such alterations except in so far as such loss is by law incapable of exclusion.
The information available on or through this site, and the services supplied via or in connection with this site or at Elevated Pilates do not constitute medical advice and it is your responsibility to determine, through obtaining appropriate medical advice, that you are fit and well and that such contents and services are suitable for you. It is not our responsibility to do so. Before commencing any exercise regime, you should consult your doctor.
It is also vital that you supply us with correct information about yourself. We cannot be liable for any incorrect information supplied by you to us. We try to make sure that all information contained on this web site (and provided by us to you as part of any services or products) is correct, but, subject to the paragraph below, we do not accept any liability for any error or omission and exclude all liability for any action you (your legal representatives, heirs) may take or loss or injury you may suffer (direct or indirect including loss of pay, profit, opportunity or time, pain and suffering, any indirect, consequential or special loss, however arising) as a result of relying on any information on this web site or provided through any service supplied by us to you.
You, your legal representatives and your heirs release waive, discharge and covenant, not to sue Elevated Pilates and its instructors for any injury or death caused by their negligence or other acts.
21. Personal belongings
Personal belongings are brought onto the Studio premises at the Clients’ own risk and our Company does not accept liability for any loss or damage whatsoever to such items. There are baskets in the cupboard where your belongings can be placed and are always in view from your equipment. We request that phones are to be silenced upon arrival to ensure no interruptions during class. No phone calls may be received or made during a class session. For extenuating circumstances, we ask for you to notify your instructor at the start of class session to minimise class disruption with respect to other clients in your session.
22. Dress code
Clients are encouraged to wear clothing that is comfortable and suitable for exercise such as leggings, shorts, track suit bottoms and tops, sports tops/ vests or t-shirt. Socks must be worn at all times and grip socks are highly recommended for safety. Grip socks can be purchased in studio. (these are available for purchase at the studio).
Footwear should be removed in the changing area before entry to the studio area.
23. Safety & Hygiene
We request all clients to be conscious of hygiene and wash hands before arrival in the facilities located immediately outside the studio door, as needed. There will also be hand sanitizer available in studio. We request clients make their way to the seating area upon entering and remove footwear before going to the Reformers. There will be baskets for belongings inside the cupboard to place alongside your footwear. Clients are discouraged from walking around the studio barefoot.
Clients will be provided with a cloth and spray to wipe down any accessories and equipment utilised during their session.
The studio will be kept clean and in a hygienic manner. Please do not hesitate to notify staff if you feel that anything is not up to standard or broken. This includes any equipment utilised during your sessions.
In the event of a fire, Clients are asked to make their way to the nearest available exit and down the stairs.
Smoking or vaping is strictly forbidden in the Studio and on our premises. Our building is under video surveillance and the building has a fire alarm.
24. Contagious illness/COVID-19 Assumption of risk
The Company assumes no liability for any COVID-19 related loss, damage or injury except as cannot be excluded by law. We do ask that if you test positive for COVID that you contact us immediately if you have attended a class in the last 48 hours prior to testing positive. Pease email info@elevatedpilates.co.uk to let the staff know. We do ask for you to please use your best judgement always when not feeling well to ensure the safety and health of yourself and others.
25. Force Majeure
We shall not be liable to you or deemed to be in breach of these terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these Terms if the delay was due to any cause beyond our reasonable control, including, but not limited to, acts of god, terrorism, explosion, flood, storm, fire, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), I.T, viruses, difficulties in obtaining raw materials, labour, fuel, parts or machinery, power failure or breakdown in machinery.
26. Waiver
No delay or failure by either party to exercise any of its powers, rights or remedies under these Terms will operate as a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver, to be effective, must be in writing.
27. Severability
If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.
28. Entire Agreement
These Terms together with our disclaimer and any policies we have in force from time to time constitute the entire agreement between us and you and shall have effect to the exclusion of any other memorandum, agreement, or understanding of any kind, whether oral or written, between us and you.
29. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with British law and the parties hereby agree to submit the exclusive jurisdiction of the British courts.
30. Third Party Rights
These Terms constitute a contract between you and us. No other person shall have the right to enforce any of these Terms.
31. General
Clients are required to give written notice to the Company of any change of address, by email. Failing such notice, all communications will be assumed to have been received by the Clients within five days of mailing to the last address notified to the Company.
The Company reserves the right to refuse admission to the Studio.
The Company may assign the benefit of the Registration Process and a Clients relation to a third party at any time without notice to the Clients.
A person who is not a party to the Registration Process has no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of the Registration Process.
The Company may, if a clients so wishes, communicate with the Clients by electronic mail (“email”). By providing an email address to the Company the Clients consents to receiving email communications from the Company, including notices pursuant to the Terms and Conditions. The Clients also accepts the risk that email may not be a secure and confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with a clients by email.
Clients must always observe the Studio guidelines which may be notified to them from time to time and are requested to comply with any reasonable directions which the management of the Studio may issue to ensure the smooth operation of the Studio for the convenience of all Clients.
Any marketing, educational or other materials of any nature whatsoever produced by the Company in connection with the Studio and which are made available to Clients at the Studio will always remain the property of the Company and will be subject to the Company’s copyright.
